By downloading, installing, accessing, or using Visual MD, you agree to these terms. If you do not agree, do not use Visual MD. ## Licences that apply A copy obtained through the Mac App Store is licensed under [Apple's Standard End User License Agreement](https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), unless the App Store presents a custom agreement. These terms supplement that agreement and do not replace it. Visual MD's source code and documentation are available under the [MIT License](https://github.com/JosephGabito/visualmd/blob/main/LICENSE). Nothing in these terms restricts rights granted by that license. If these terms conflict with the applicable App Store agreement or the MIT License, that agreement or license controls for its subject matter. ## Free availability Visual MD is currently provided without charge. Free availability does not create a promise that any version, feature, update, support channel, or distribution method will remain available. We may change, suspend, or discontinue any part of Visual MD at any time to the extent permitted by law. ## Your files and responsibilities You retain all rights in the files you open with Visual MD. You are responsible for having the right to use those files and for maintaining complete, current backups. Visual MD is a reader, not a backup, archival, recovery, or records-management service. Do not rely on it as the only copy of any document or as the sole means of accessing important information. You are responsible for deciding whether Visual MD is suitable for your needs, for granting and revoking file permissions, and for the consequences of opening links, remote images, themes, or other content referenced by your documents. ## Acceptable use You may use Visual MD only in compliance with applicable law and the rights of others. You must not misuse the website, interfere with its operation or security, attempt unauthorized access, or use Visual MD to distribute unlawful or infringing material. The Visual MD name and logo are not licensed under the MIT License; their use is governed by the project's [trademark guidance](https://github.com/JosephGabito/visualmd/blob/main/TRADEMARKS.md). ## External content and services Visual MD can display or open content supplied by you or by third parties, including links, remote images, fonts, and diagrams. Third-party content and services are controlled by their respective providers. We do not endorse, verify, or assume responsibility for their availability, security, accuracy, legality, or privacy practices. Your use of them is at your own risk and may be governed by separate terms. ## No support or update commitment Unless required by applicable law, we have no obligation to provide maintenance, technical support, updates, compatibility fixes, data recovery, or continued access. Information offered through documentation, issue discussions, or other support channels is general guidance and does not create a warranty or professional-services relationship. ## No warranty TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VISUAL MD IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES, WITHOUT LIMITATION, WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, TITLE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, AND THAT VISUAL MD WILL BE ERROR-FREE OR PRESERVE ANY CONTENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE CREATES A WARRANTY. ## Limitation of liability TO THE EXTENT NOT PROHIBITED BY LAW, JOSEPH GABITO, VISUAL MD'S CONTRIBUTORS, AND THEIR RESPECTIVE AFFILIATES WILL NOT BE LIABLE UNDER ANY LEGAL THEORY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OR CORRUPTION OF FILES OR DATA; LOSS OF PROFITS, REVENUE, GOODWILL, OR OPPORTUNITY; BUSINESS INTERRUPTION; DEVICE OR SOFTWARE FAILURE; OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO VISUAL MD OR YOUR INABILITY TO USE IT, EVEN IF ADVISED THAT SUCH LOSS IS POSSIBLE. TO THE EXTENT A LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO VISUAL MD WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY FOR VISUAL MD DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US$50.00. THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. ## Claims arising from your conduct To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Joseph Gabito and Visual MD's contributors from third-party claims, damages, and reasonable costs arising from your unlawful use of Visual MD, your violation of these terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from conduct for which liability cannot lawfully be excluded. ## Rights that cannot be waived Some jurisdictions do not allow certain warranty exclusions or liability limitations. Nothing in these terms excludes, restricts, or modifies a statutory guarantee, consumer right, or liability that applicable law does not permit us to exclude, restrict, or modify. Where a restriction is not fully enforceable, it applies only to the maximum extent permitted by law. ## Changes to these terms We may update these terms when Visual MD or the law changes. The effective date above identifies the current version. Where required by law, a material change will apply only after appropriate notice. Your continued use after an updated version takes effect constitutes acceptance to the extent permitted by law. ## General terms These terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules, except where mandatory law in your place of residence applies. Unless mandatory law provides otherwise, disputes are subject to the jurisdiction of the appropriate courts of the Philippines. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver.
